§1 Operator and Scope

1.2 Scope of Application
These Terms and Conditions apply to all users of the free browser game "The Unemployment Game" (hereinafter "Game" or "Service"). By registering or logging in, the user confirms having read and understood these terms and agrees to their validity.
§2 Registration and User Account
2.1 Requirements
Using the game requires registration. By registering, the user confirms:
- being at least 16 years old
- providing truthful information
- having read and accepted these Terms and the Privacy Policy
- agreeing to the use of Google Analytics and Google AdSense
2.2 Account Security
The user is responsible for keeping their login credentials confidential. Sharing login credentials with third parties is prohibited. If misuse is suspected, the user must inform the operator immediately.
2.3 One Account per Person
Each user may only have one game account. Creating multiple accounts (multi-accounting) is prohibited and may result in blocking of all affected accounts.
§3 Service Description
"The Unemployment Game" is a free browser game (Free-to-Play) where players can perform various activities in a satirical game world. The operator provides the game free of charge and finances it through:
- Advertisements (Google AdSense)
- Optional in-game purchases
§4 In-Game Purchases and Payments
4.1 Virtual Goods
In the game, optional virtual goods, currencies, or advantages can be purchased for real money. These virtual goods:
- have no real monetary value outside the game
- are not transferable or redeemable
- may be lost upon account deletion or game discontinuation
4.2 Payment Processing
Payments are processed via PayPal. By purchasing, the user agrees to PayPal's terms of use. The purchase price is due immediately.
4.3 Right of Withdrawal
Cancellation policy for digital content:
For digital content (virtual goods, in-game currency), the right of withdrawal expires prematurely if the user has expressly agreed that the operator may begin contract execution before the withdrawal period expires, and the user has confirmed knowledge that this consent results in loss of the right of withdrawal. This occurs with each purchase through corresponding confirmation.
4.4 Prices
All prices shown are final prices including statutory VAT (where applicable). The operator reserves the right to adjust prices for future purchases.
§5 Advertising and Google Services
5.1 Google AdSense
We use Google AdSense to display advertisements. Google AdSense uses cookies and similar technologies to show interest-based advertising. Data such as IP address, device identifier, and browsing behavior may be transmitted to Google. For more information, see Google's Privacy Policy.
5.2 Google Analytics
We use Google Analytics to analyze user behavior and improve our service. Google Analytics uses cookies and transmits usage data to Google servers in the USA. IP anonymization is enabled. The legal basis is your consent according to Art. 6(1)(a) GDPR.
5.3 Google reCAPTCHA
To protect against bots and automated access, we use Google reCAPTCHA. Technical data (IP address, dwell time, mouse movements) is transmitted to Google and processed according to Google's privacy policy.
5.4 Consent Requirement
Using the game requires consent to the above Google services. Without this consent, login or registration is not possible, as these services are necessary for operating and financing the free game.
§6 Code of Conduct
The user agrees to refrain from the following actions:
- Distributing offensive, racist, sexist, or otherwise illegal content
- Using cheats, bots, hacks, or other unauthorized tools
- Exploiting bugs or game errors for personal advantage
- Harassing other players
- Trading game accounts or virtual goods for real money outside the game
- Spreading spam or advertisements in the chat
- Circumventing game mechanics or security measures
§7 Liability and Warranty
7.1 Availability
The operator strives for uninterrupted availability of the game but does not guarantee this. Maintenance, technical issues, or force majeure may lead to temporary outages.
7.2 Limitation of Liability
The operator is only liable for damages resulting from injury to life, body, or health, as well as damages based on intentional or grossly negligent breach of duty. Otherwise, liability is excluded to the extent permitted by law.
7.3 Data Loss
The operator assumes no liability for loss of game data (game progress, virtual goods, inventory) unless the loss was caused intentionally or through gross negligence.
§8 Termination and Blocking
8.1 Termination by User
The user can have their account deleted at any time without giving reasons. An email to support is sufficient. Upon deletion, all virtual goods and game progress are irrevocably forfeited.
8.2 Blocking by Operator
The operator is entitled to temporarily or permanently block user accounts for violations of these Terms. No prior warning is given for serious violations. Amounts already paid for virtual goods will not be refunded in case of justified blocking.
§9 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy. This is part of these Terms. By agreeing to these Terms, the user also confirms acknowledgment of the Privacy Policy.
Usage specifically includes consent to:
- Storage of registration and game data
- Use of cookies for login and analytics
- Processing by Google AdSense and Google Analytics
- Use of Google reCAPTCHA for abuse protection
§10 Changes to Terms
The operator reserves the right to change these Terms at any time. Users will be informed of significant changes by email or at the next login. If the user does not object to the new Terms within 14 days and continues to use the game, the amended Terms are deemed accepted.
§11 Final Provisions
11.1 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
11.2 Place of Jurisdiction
The place of jurisdiction for all disputes arising from or in connection with this contract is, to the extent permitted by law, the District Court of Crailsheim.
11.3 Severability Clause
Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. Instead of the invalid provision, a valid regulation is deemed agreed upon that comes closest to the economic purpose of the invalid provision.
11.4 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
